In addition, you can face criminal charges for driving an overweight truck if the overweight truck causes an accident. Criminal penalties include:
- Assault. For assault with an overweight truck, you face several penalties. You face a prison sentence of up to 20 years and/or a fine of $15,000 (for first degree assault). For second degree assault, you face a prison sentence of up to five years. Also, you face a fine of up to $5,000.
- Manslaughter: For manslaughter with a vehicle carrying excessive weight, you face a prison sentence of 20 years and a fine of $15,000 for first degree manslaughter. For manslaughter in the second degree with an overweight vehicle, you face a fine of $10,000 and a prison sentence of as much as 10 years.
- Reckless endangerment: If you are found guilty of first degree reckless endangerment with an overweight vehicle, you face a jail sentence of up to one year and a fine of up to $2,000. For reckless endangerment in the second degree, you face a fine of $1,000 and a jail sentence of up to six months.
