Factors for Release
If you face an arrest, the bail staff will be in charge of your ability to be released from custody. This oftentimes happens during a bail hearing, also known as an arraignment. In order for you to be released from police custody, bail must be granted. But bail depends on many factors for release. You can learn more about these factors for release here.
Factors for Release
Bail staff have the option of either increasing or decreasing the amount set by police. The amount of bail is determined by bail staff in order to decide what type and exactly how much bond the defendant should post. Bail staff will use a series of factors for release known as “weighted release criteria” required by Connecticut Statutes such as the:
- Seriousness of the criminal charges.
- Nature and circumstances of the offense.
- Defendant’s record of previous convictions and prior criminal history.
- Defendant’s past record of appearances in court after the approval of bail.
- The defendant’s family ties.
- Defendant’s employment record.
- Defendant’s financial resources.
- The defendant’s character and mental condition.
- Defendant’s community ties.
It is important to know that an arrested person has a right to an interview by bail staff during nights, weekends, or when court is not in session. With the exception of cases whereby a person gets arrested on a warrant signed by a judge and the bond amount has already gotten set or denied by that judge, all people arrested have the right to an interview about the terms and conditions of their release.
