Assault In The First Degree

Assault in the first degree is a Class B felony. It carries the following penalties:

  • A prison sentence of up to twenty years. There is a minimum prison sentence of five years if the assault was committed with a deadly or dangerous weapon. There is a minimum 10 year sentence if the victim is under 10 years of age or is a witness injured in assault.
  • A fine of up to $15,000.
